# Freelance content creators and the risk of disguised employment

Disguised employment, Scheinselbstständigkeit, describes a situation where a person formally invoices as a freelancer but the law treats the actual relationship as employment, since what decides it is not the contract's title but how the work is really organised.

Germany's pension authority, the Deutsche Rentenversicherung, weighs several signs together, whether the person works for only one client, is integrated into the company's structure with fixed hours, uses the client's equipment, carries genuine entrepreneurial risk and receives instructions not just on what to do but on exactly how to do it.

For a content creator that looks concrete. Someone who films only for one brand, at fixed hours the brand sets, on the brand's equipment and following a detailed script with an exact shot list and editing style, ticks several risk boxes at once compared with someone serving several clients on their own schedule with their own gear.

If the relationship gets reclassified, the company owes retroactive employer social security contributions, usually for the last four years, up to thirty in cases of proven intent, plus a possible fine, and the person can gain employee rights.

Several things lower the risk together. Multiple clients rather than one, a free schedule and workplace where that is realistically possible, the freelancer's own equipment, a contract describing a deliverable rather than step-by-step instructions, and the right to turn down a specific assignment.

A written freelance contract helps as evidence of intent, but it does not override the actual facts, since both a court and the pension authority look at how the work genuinely runs, not just the text on paper.

Germany's Statusfeststellungsverfahren, run through Deutsche Rentenversicherung Bund, offers a way to get a binding decision on status in advance, particularly worthwhile for a long, close working relationship.

Reclassification affects the freelancer too, since they can lose deductions they claimed as self-employed and end up owing tax under a different treatment.
