# The WhatsApp button on a website and the GDPR

A WhatsApp widget on a website is technically a link or an embedded script pointing at Meta's service, and depending on how it is built, either the click on it or the page load itself can transmit a visitor's IP address and browser data to Meta's servers in the US, following the same pattern already covered for embedded fonts, maps and videos.

Two fundamentally different setups exist. A plain link in the wa.me format carrying the company's number only opens WhatsApp on click and loads nothing from an outside server before that. An embedded chat widget with its own Meta script, by contrast, starts transmitting data as soon as the page loads, before the visitor has clicked anything at all.

For the plain link, no consent is needed before the click, since nothing loads from an outside server until then, though it helps to note next to the button that clicking it opens WhatsApp and leaves the site, and to mention that in the privacy policy.

An embedded chat widget needs prior consent through the banner, exactly like embedded maps and videos, and its script must not start until the visitor has accepted in the banner.

The data transmitted includes the IP address, browser data and, if a pre-filled message is used, its text, which counts as a transfer to a third country without a full adequacy guarantee, so the privacy policy needs to name the appropriate transfer safeguards.

The simpler, lower-risk option in practice is to style the plain wa.me link as a button with an icon and a label such as message us on WhatsApp, with no third party script loading before the visitor actually clicks.

Regardless of the setup, the privacy policy has to name WhatsApp and Meta as the recipient, mention the data transfer itself and link to Meta's own privacy notice.

An ordinary contact form or a direct phone link is worth considering as an alternative, solving the same quick-contact job without transferring any data to a third party service at all, which helps especially with a privacy-sensitive audience.
