# Can we just use 'Erzgebirgische Volkskunst' in our Google Ads copy in Annaberg-Buchholz?

We make traditional folk crafts in Annaberg-Buchholz and wanted to freely use the term 'Erzgebirgische Volkskunst' in our Google Ads copy, because it clearly performs well on search.

Another business in the region warned us that this is legally trickier than it sounds. Is that true, and where would a problem even come from?

The term 'Erzgebirgische Volkskunst' isn't actually a freely available generic term, it's registered with the German Patent and Trademark Office as a protected designation and was officially recognized as intangible cultural heritage on 26 March 2025\. Careless use in ad copy can therefore genuinely touch a real trademark question. This isn't just a stylistic one.

Google itself doesn't automatically screen ad copy for trademark violations, the system only becomes active reactively, once the actual rights holder files a complaint. Until such a complaint, a problematic ad simply keeps running normally, which easily creates the false impression that the use is automatically fine.

Someone producing a genuine product from within that protected tradition, using the term in a descriptive sense, is generally on safe ground, whereas a blanket promotional use with no real connection is the actual risk.
