# An influencer with 100,000 followers promoted our jacket, and it brought us almost nothing. Can we ask for it back?

A collaboration with an influencer with around 100,000 followers barely worked, no noticeable reach and no sales. It isn't clear whether the product sent can be reclaimed.

We sent a jacket from our label to a fashion blogger with around 100,000 followers, and in return she was supposed to post photos wearing it. The post went up, but it brought almost nothing, no noticeable reach and no measurable sales.

There was no written agreement with specific terms, just a loose arrangement over messages.

Can we ask for the jacket back, since the collaboration didn't achieve its purpose?

Without a written agreement specifying deliverables or a success threshold, you have almost no legal way to reclaim the jacket. The influencer held up her end, she posted, and the fact that it brought little was never recorded anywhere as a measurable criterion.

The comparison to classic advertising fits quite well here. A radio or TV ad that flops doesn't get the airtime refunded either, because what was exchanged was the broadcast itself; any particular result afterward was never part of that exchange.

Looking at it a bit more closely: the influencer genuinely put in effort, a photo, a mention, her own reach spent on this. That her reach simply didn't land with your audience is a risk that comes with any collaboration without a guaranteed outcome, regardless of good faith on both sides.

For the next collaboration, this is avoidable: a written agreement with specific deliverables, say the number and type of posts, plus a clear rule for what happens if certain numbers aren't hit, whether that's reduced payment or a duty to return the product.
