# Our site is information only, with a contact form. Does the accessibility law still apply to us?

An engineering firm of 14 people. Nothing is sold or booked online and every contract is agreed by phone. The question is whether a contact form alone counts as electronic commerce.

We are an engineering firm with 14 people. The website has our services, reference projects, a team page and a contact form. Nothing is sold or booked online, every job goes through a phone call and a written quote.

Since the deadline in late June 2025 we keep reading that websites have to be accessible. Our accountant asked in passing in July whether we had dealt with it. At 14 employees we do not qualify as a microenterprise, so that way out is closed.

What I cannot find anywhere is a clear statement on whether a contact form on its own is enough to count as electronic commerce.

It comes down to one definition, and that definition sits in the statute itself.

[Section 1(3) BFSG](https://www.gesetze-im-internet.de/bfsg/%5F%5F1.html) lists the services the act covers, among them services in electronic commerce. [Section 2(26)](https://www.gesetze-im-internet.de/bfsg/%5F%5F2.html) says what those are: digital services offered through websites or apps where the contract is concluded electronically at the individual request of the customer. The deciding part is where the contract is concluded. In your case that happens on the phone and in a written quote, not on the page.

To be straight with you, the contact form question is genuinely disputed among lawyers, and anyone selling you a clean yes or no is pretending the matter is settled.

The cautious reading rests on a distinction you can actually test: a form that sends a message is one thing, a form that confirms a booking or fixes a price is another.

So the more useful question is not where you stand today but what you add to the site next. A booking tool, a calendar that confirms slots, a calculator that returns a figure. Each of those moves the page closer to concluding a contract, and the question reopens.

Separately from the law, the cheap half of accessibility pays for itself even if you are outside its scope. Contrast, keyboard navigation, sensible labels on form fields and alternative text are one-off work, and they help everyone reading the site, including the machines that parse it.
