# We have no analytics and no tracking. Do we still need a cookie banner?

Eight pages, a contact form, a map embedded as an image. Analytics went in January, the banner still pops up on every visit and customers complain about it.

Our site consists of eight pages, a contact form and a map that we embedded as an image. We threw Google Analytics out in January because nobody ever looked at it.

There is still a cookie banner over the top of it, popping up on every visit, and our customers complain about it. Our former provider says it is mandatory and that we risk a warning letter otherwise.

I do not understand what we are collecting consent for if we store nothing.

Your confusion is closer to the legal position than your former provider's answer is.

The duty does not attach to the word cookie, nor to whether a website has any. It attaches to an action: [Section 25(1) TDDDG](https://www.gesetze-im-internet.de/ttdsg/%5F%5F25.html) requires consent for storing information on the user's device and for accessing information already stored there.

If your site stores nothing and reads nothing, there is nothing for consent to cover.

And even where something is stored, consent is not automatically due. Subsection 2 number 2 carves out whatever is strictly necessary for a service the user has expressly requested to function at all. A session cookie protecting your contact form against double submission usually sits in that carve-out.

Before you switch the banner off, look at what your site actually does. Open it in a fresh browser window, go into the developer tools and look under storage at what gets created. Pay particular attention to whatever the content system sets by itself, and to fonts or maps loaded from other people's servers. You say your map is an image, which is good, because an embedded map would be exactly that kind of case. If nothing turns up, the banner can go. The privacy policy still needs to say what happens to the data from the contact form, since that is a separate question and tends to get thrown out along with the banner.

A banner collecting consent for nothing protects you from no warning letter either. Spend the half hour on finding out what your own site actually loads.
