# We have six employees. So the accessibility act does not apply to us, does it?

Six staff, turnover under two million, nothing sold online. Two articles say the opposite about the exemption.

We read about the German accessibility act and concluded it does not apply to us. Six employees, turnover under two million, no trade in goods, services only.

Then two articles turned up one after the other. One said there is an exemption for companies our size. The other said it does not always apply, and went on about products, services and various thresholds. We have no lawyer for this, and the website is two years old and has barely been touched since.

The site has a service catalogue, a pricing page and an enquiry form. Nothing is paid for online.

So does the exemption cover us or not?

Six employees on their own are not enough, because the threshold and the exemption sit in two different places in the act.

The definition of a microenterprise is in [Section 2(17) BFSG](https://www.gesetze-im-internet.de/bfsg/%5F%5F2.html): fewer than ten employees, plus either annual turnover of no more than 2 million euros or an annual balance sheet total of no more than 2 million. The exemption itself comes from [Section 3(3) BFSG](https://www.gesetze-im-internet.de/bfsg/%5F%5F3.html), and it is exactly one line: subsection 1 does not apply to microenterprises that offer or provide services. It says nothing about goods, so an online shop falls outside it regardless of company size.

The act has applied since 28 June 2025.

So the answer depends on what is on your site. A service catalogue, a pricing page and an enquiry form are services, and at six employees the exemption applies. Add a buy button and it stops applying.

Even where the exemption applies, part of the requirements is worth doing. Text contrast, keyboard operation, image descriptions and clear labels on form fields are one-off work, and they help everyone reading the site, search engines included.
